DemDaily: Barriers to the Ballot Box: The SAVE America Act
March 25, 2026
The US Senate is debating the Safeguard American Voter Eligibility (SAVE) America Act, the "Voter ID" bill that would block millions of Americans from registering their voice -- online, by mail, and in person at the ballot box.
President Donald Trump has called passage of the dangerous voter suppression bill -- which requires proof of citizenship to register to vote -- his number one priority.

What is the SAVE America Act?
The SAVE Act (H.R.7296/S.1383) is proposed federal legislation aimed at "securing election integrity" by significantly restricting voter registration eligibility for federal elections.
Although citizenship is already a requirement to vote in the US, and instances of illegal noncitizen voting are extraordinarily rare, the Act feeds Trump's unrelenting claims of voter fraud stemming from the 2020 elections. Republicans, who are increasingly forced to draw a line in their proactive support of the president, claim the bill provides necessary and "common-sense safeguards" of our country's democratic process.
If approved, these unprecedented barriers to the ballot box would have a profound effect on the election process and, most decidedly, a higher percentage of voters who historically fall within the Democratic base.
Core components include:
* Proof of Citizenship: It amends the National Voter Registration Act of 1993 by requiring voters to provide documentary proof of U.S. citizenship (such as a passport, birth certificate, or naturalization documents) in person when registering to vote or updating voter registration.
More than 21 million Americans are unable to access the documents required under these bills. Roughly 150 million Americans do not possess a valid US passport. People of color, married people who have changed their names, and young and elderly citizens are more likely to have difficulty accessing birth certificates or other officially sanctioned proof of citizenship.
Registered voters will also be impacted -- whenever someone updates their registration or changes their address or political party, they would need to provide these documents in person.
* Stricter Voter ID: It imposes strict photo ID requirements for voting in person. In the vast majority of states, a driver's license alone would not be sufficient because those licenses do not indicate citizenship.
* Online Voter Registration and Mail-In Registration: The Act mandates that any applicants registering to vote by mail include copies of proof of citizenship with their applications. The bill's impact on paperless voter registration -- which is offered by 42 states, Washington, D.C., Guam, and the Virgin Islands -- could, in practice, end online and mail-in registration -- suppressing the votes of millions of eligible citizens who lack immediate access to these documents.
| We should not make "any deal with the Crazy, Country Destroying, Radical Left Democrats unless they vote with Republicans to pass ‘THE SAVE AMERICA ACT...Voter I.D. (with picture!), Citizenship to Vote, No Mail-In Voting (with exceptions), All Paper Ballots, No Men In Women’s Sports, and No Transgender MUTILIZATION of our precious children. Put it all together, and also, let Leader Thune clearly identify those few ‘Republicans’ that are Voting against AMERICA. They will never be elected again!” - President Donald Trump, Truth Social, March 22 |
* Voter Roll Purges and Mandated Database Sweeps: It requires states to turn over their voter rolls to the Department of Homeland Security (DHS) to run through the Systematic Alien Verification of Eligibility database every election cycle, and monitor potential noncitizens registered in their system.
While many states utilize the database for specific cases, none implement sweeping extents or regular intervals. Dozens of states have refused to provide voter files requested by the Trump administration because of concerns about misuse of data.
* Immediate Enforcement: It provides no phase-in period for states to accommodate the bill's provisions and requires state compliance effective immediately. States unable to enforce the new regulations may be forced to hold state and federal elections separately or maintain separate voter rolls for each election.
Legislative Status
The bill has passed the House but has been gridlocked in the Senate, where debate began March 17.
US House
The House passed H.R.7296, the SAVE America Act, on February 11 by a 218–213 vote, primarily along party lines. Only one Democrat, Congressman Henry Cuellar (TX), voted with the GOP.
US Senate
The Senate version of the SAVE America Act, S.1383, includes several high-profile amendments, including "social policy riders" that were not in the original H.R. 7296:
* Photo ID Deadline: The requirement for a specific "valid, unexpired photo ID" now applies to any federal election held on or after November 1, 2026.
* Purge Requirements: States are required to begin the first mandatory "noncitizen purge" of their voter rolls within 90 days of the bill's enactment.
* Protection of Women's Sports: Prohibits transgender athletes from participating in women's sports at any institution receiving federal funding.
* Ban on Gender-Affirming Care: A section that restricts federal funding for gender-reassignment surgeries for minors.
Yesterday, the Senate temporarily paused consideration of the SAVE America Act to prioritize a Homeland Security funding deal. The bill is expected to return to the floor after the Easter recess, although it faces steep odds for passage.
Despite the pressure from the White House, the reality is that Republicans hold a 53-47 majority -- lacking the 60 votes needed for "cloture" required to overcome a Democratic filibuster.
Senate Majority Leader John Thune (R), speaking to reporters, acknowledged that it would be "very, very difficult" to pass the bill in its current form without "nuking the filibuster," adding, "That's just not going to happen."

Trump has declared he will not sign any other legislation, specifically DHS funding, until Congress passes the SAVE America Act.
