DemDaily: Arrested and Arraigned

June 14, 2023

Former President Donald Trump on Tuesday was arrested and arraigned on 37 felony counts related to his alleged illegal transfer, detention and coverup of highly classifed United States secrets in violation of the Presidential Records Act (PRA).

More than 325 classified documents that have been recovered from Trump's Florida estate since the Department of Justice (DOJ), at the urging of the National Archives and Records Administration (NARA), began its investigation in February 2022.

Most of the documents, which the former president haphazardly hid throughout his Mar-a-Lago resort, concerned the “defense and weapons capabilities” of the United States and foreign countries.

The former president, who decried the indictment as a "witch hunt" and "election interference," was fingerprinted but not required to sit for a mugshot during the 45 minute arraignment process -- in which he pleaded 'Not Guilty."

He was freed on his own recognizance with no limit on his domestic or international travel. Trump later flew in his private jet to New Jersey, where he addressed supporters at his Bedminster Golf Resort.

The Trials of Trump
The Department of Justice's (DOJ) charges come on the heels a May 9 verdict by a Manhattan federal jury, which found Trump liable in a civil case for the sexual abuse and defamation of former Elle magazine columnist and author E. Jean Carroll.

One month earlier, on April 4, 2023, Manhattan District Attorney Alvin Bragg handed down an indictment against Trump on 34 felony counts of falsifying business records in the first degree. The case involved a hush money scheme -- carried out in the final months of the 2016 presidential election -- to silence adult film star Stormy Daniels about a past affair she had with Trump. A trial date is set for March 25, 2024.

The Trump Organization was convicted in New York State Supreme Court in December 2022 on 17 counts of tax fraud, grand larceny and falsifying business records, but Trump and his children, who are senior executives in the company, were not charged personally at the time.

In September 2022, New York Attorney General Letitia James' announced a $250 million civil lawsuit charging Trump, the Trump Organization, three of his adult children and others for their part in a decade-long scheme to criminally defraud tax authorities. It is scheduled to go to trial October 2, 2023.

In Fulton County, Georgia, Trump and his allies are under criminal investigation regarding their coordinated efforts to overturn the state's 2020 presidential election results. That includes Trump's documented attempts to personally pressure the Georgia Secretary of State, and his role in the scheme to send a fake slate of electors to Georgia's state Capitol.

In January 2023 Fulton County Superior Court Judge Robert McBurney announced that a special grand jury had concluded their criminal investigation into the matter and submitted their findings to Fulton County District Attorney Fani Willis, who is reviewing them before she presents them to a regularly seated grand jury for criminal charges. Willis has requested courthouse judges not to schedule trials during the second and third weeks of August 2023.

Trump is also expected to face the outcome of the DOJ investigation into the 2021 insurrection at the US Capitol. As a part of his role as Independent Special Counsel, Jack Smith now has oversight of that investigation, including the criminal referrals against Trump made in December 2022 by the House Select Committee to Investigate the January 6th Attack.

Trump is also facing other investigations, lawsuits and/or potential prosecution by Weschester County, the District of Columbia, the US House of Representatives, the Securities and Exchange Commission and Financial Industry Regulatory Authority, the US Capitol Police and DC Metropolitan Police, Dominion Voting Systems, former 2016 campaign staff, former employees and tenants, among others.
